74 Discoverys customers submit claims

JAKARTA: Task Force for Handling of Customer Complaints received claims from 74 customers of PT Discovery Futures, a futures brokerage that was suspended since mid-June.According to the Task Force Chief who also acted as PT Jakarta Futures Exchange (JFX) President Director Made Sukarwo, such customer claim is still verified up to July 19.Then after the date, the task force will formulate measures to settle the customer fund."The formulation result will be submitted to the Head of the Commodity Futures Trading Supervisory Board [Bappebti] for approval before being implemented," he said to Bisnis yesterday.Earlier, the Head of Bappebtis Legal Bureau Alfons Samosir estimated Discoverys customer claim is reaching to IDR3 billion.The Task Force for Handling of Customer Complaints comprising representatives from BBJ, Bappebti, and PT Perusahaan Kliring Berjangka (KBI) is currently handling the customer claim settlement.The task force is permanent and its established to handle such cases, BBJs President Director Made Sukarwo said.In mid last year, 31 customers filled claim with a value of IDR700 million.The task force is not tasked to return all customer funds that are harmed by Discovery Futures, BBJs Head of Legal Division who also acted as task force member Rio Yuszarro said.If the claim value exceeds Discoverys assets then the customer fund will be returned proportionally.Made Sukarwo and Rio Yuszarro declined to disclose how many claims that are filed and how many assets that can be used to pay.However, the companys clearing guarantee worth IDR1.2 billion and sales of seat or membership in the exchange market can be used to pay the claim."If the whole clients obligation cant be fulfilled then they can file a civil suit to the broker for the remaining funds that cant be restored," he said.Bappebti suspended Discovery Futures business license since the company has not fulfilled minimum capital requirement of IDR15 billion.Such requirement failure was revealed after Bappebti together with BBJ and KBI audited the company following the embezzlement of PT Elnusa Tbk funds in PT Bank Mega Tbk.The audit result shows that the company has allegedly misused clients' funds in separate accounts, which led to destruction of the required financial integrity and business reputation.In the embezzlement case, part of the funds were transferred to Discovery Indonesia and then forwarded to PT Harvestindo Asset Management.Although, Discovery Futures has previously denied receiving the transferred funds but some of its officers were also acted as the management officers of Discovery Indonesia and Harvestindo.Ivan Christovano Litha as the embezzlement suspect was acted as the main commissioner of Harvestindo, CEO of Discovery Indonesia and Discovery Futures President Director.Meanwhile, another Discovery Indonesias CEO Andhy Gunawan was also acted as the commissioner of Discovery Futures. Both companies have the same office address at Thamrin Tower, Kebon Sirih, Jakarta.Ivan Gunawan and Andhy Litha will not be licensed as futures brokers if they are proven guilty in court of law, Bappebtis Chief Syahrul R.
