JAKARTA: Australian-based Colonial Service Pty Ltd won over a lawsuit of First State brand removal against PT First State Futures, a brokerage firm. The statement is pursuant to Commercial Court's verdict in Jakarta, last week.In its consideration, panel of judges, led by Tjokorda Rae Suamba, stated PT First State Futures, as the plaintiff, failed to prove all of its lawsuit arguments. Plaintiff failed to provide evidence that Colonial Service, as defendant, did not occupy First State brand for three consecutive years. Plaintiff was sentenced to pay legal fees.Defendant attorney Sigit Nugraha welcomed the verdict. However, he objected judges refusal over counterclaim.In counterclaim we claimed for the cessation of the use of brand, not brand cancelation but in the basis of considerations, the panel stated cancelation.The lawsuit registered at Central Jakarta Commercial Court No. 04/Merek/2011/PN.Niaga.Jkt.Pst.Plaintiff filed for First State trademark registration for class 36 No. J002010037991 on October 25, 2010 and First State Futures brand for class 36 No. J002010037992 on the same day.
